The Cosmic Pact is the shared light of our community — and, in legal terms, it constitutes the End User License Agreement (EULA) / Terms of Service for LastEmber ("we," "us," "our"), forming a binding legal agreement between you and us. By downloading, accessing, or using the LastEmber app (the "App"), you agree to be bound by this Pact, our Privacy Policy, and our Community Guidelines. If you do not agree, do not use the App.
To ensure this space remains a place of genuine connection, we reserve the right to remove any Moments or other content that threaten the safety or rights of others, including content that is illegal, abusive, infringing, or harmful. The rest of this Pact explains exactly how, and when.
You must be at least 13 years old (or the minimum age of digital consent in your country, if higher) to use LastEmber. If your country requires parental or guardian consent for users below a higher age, you may use the App only with valid consent. By using the App, you represent that you meet this requirement and that you have the legal capacity to enter into this agreement.
LastEmber uses Sign in with Apple exclusively for account creation. You are responsible for maintaining the security of the Apple ID associated with your account. We do not perform background tracking or build a social graph from your account.
LastEmber is a minimalist, low-frequency expression platform. Posting is intentionally rate-limited (one Moment per 3 days), each Moment may contain up to 140 characters of text and one photo, and distribution to other users is randomized and anonymous — there is no messaging, commenting, following, or public profile system. LastEmber is an artistic expression and emotional journaling tool. It is not a medical, mental health, therapy, or crisis intervention service, and content shared on LastEmber represents the personal expression of individual users, not the views of LastEmber.
You retain ownership of the text and images you post ("Content"). By publishing Content, you grant LastEmber a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display that Content solely for the purpose of operating the App (including anonymous distribution to other users and rendering shareable cards with the LastEmber.app watermark you generate).
By publishing any Content, you confirm that you have read and agree to abide by our Community Guidelines, and you commit not to post content that is offensive, infringing, illegal, or otherwise in violation of this Pact. Prohibited content includes, without limitation:
We use automated filters and, where necessary, human review to screen Content. We reserve the right to remove any Content, suspend distribution, or terminate any account, at our sole discretion and without prior notice, if we believe it violates this Pact or our Community Guidelines. See our Community Guidelines for the specific escalation thresholds that apply to reported content.
Every Moment card includes a visible safety control that lets you report content (Spam, Harassment, Self-harm concern, or Inappropriate content) or block the posting user. Reported content is immediately hidden from your own feed, and we commit to reviewing all reports — by automated system or human moderator — within 24 hours of submission.
To preserve the intentionally low-frequency spirit of the App, publishing is limited to once every 3 days per account. Unpublished drafts are stored locally on your device, limited to 5 at a time.
For free users, a public Moment remains visible in Cosmos and in user-facing archive surfaces for up to 30 days from publication. After day 30, that Moment is no longer visible to other users and no longer appears in Ego or other user-facing archive surfaces.
From day 30 through day 90, we may retain the underlying text and image only in our backend, solely for safety, abuse-prevention, legal-compliance, and user data-access/export purposes. After day 90, the original text and image are permanently deleted. Moment Guardianship subscribers follow a different path only for eligible Moments: a Moment is permanently preserved when server-verified subscription entitlement periods overlap the Moment's eligible preservation window or the Moment is published while a valid entitlement is active. Public distribution still ends after the public circulation period. Additional detail is provided in our Privacy Policy.
LastEmber offers an optional auto-renewing subscription called Moment Guardianship. It protects eligible Moments beyond their natural lifetime and may unlock additional Moment-related benefits over time. It is not a general cloud-storage service.
Location access is optional. If enabled, LastEmber uses only coarse, city-level location at the time of posting, and applies additional randomized offsetting (2–5 km) for any geographic visualization. You may disable location access at any time without losing access to core functionality.
We may suspend or terminate your access to the App if you violate this Pact, our Community Guidelines, or applicable law, including (without limitation) repeated content violations resulting in a shadow ban as described in our Community Guidelines. You may terminate your account at any time through Settings → Delete Account, as described in our Account Deletion Policy.
For users in the European Union, our Community Guidelines explain how to report illegal or policy-violating content, how moderation decisions are made, and how to appeal. Notices should identify the content, explain why it is unlawful or violates our rules, and include enough context for us to evaluate it. We may provide a statement of reasons where required by law. Subject to your compliance with this Pact, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App for your personal, non-commercial use on any Apple-branded device that you own or control, as permitted by the Usage Rules set forth in the App Store Terms of Service. All rights not expressly granted to you in this Pact are reserved by us.
You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist-supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties. You agree to comply with all applicable export and re-export control laws and regulations in connection with your use of the App.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE FROM OBJECTIONABLE CONTENT POSTED BY OTHER USERS, ALTHOUGH WE MAINTAIN A MODERATION SYSTEM DESIGNED TO ADDRESS SUCH CONTENT PROMPTLY. NOTHING IN THIS PACT EXCLUDES OR LIMITS RIGHTS THAT CANNOT BE EXCLUDED UNDER APPLICABLE CONSUMER LAW.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LASTEMBER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP OR ANY CONTENT POSTED BY OTHER USERS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO PARTS OF THIS SECTION MAY NOT APPLY TO YOU.
You acknowledge that this Pact is concluded between you and LastEmber only, and not with Apple, and Apple is not responsible for the App or its content. Apple has no obligation to furnish any maintenance or support services with respect to the App. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any, for the App to you; to the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to the App. Apple is not responsible for addressing any claims relating to the App, including product liability claims, claims that the App fails to conform to legal or regulatory requirements, and claims arising under consumer protection or similar legislation. Apple is not responsible for the investigation, defense, settlement, and discharge of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights. You agree to comply with applicable third-party terms when using the App. Apple, and Apple's subsidiaries, are third-party beneficiaries of this Pact, and upon your acceptance, Apple has the right to enforce this Pact against you as a third-party beneficiary.
This Pact is governed by the laws applicable in your jurisdiction of residence, without regard to conflict-of-law principles, except where superseded by mandatory consumer protection laws.
We may revise this Pact from time to time. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.
